Terms of Service

These Terms of Service (“Terms”) govern your access to and use of FindAFlip, including our website, mobile applications, and APIs (collectively, the “Service”), operated by Pierce Pokorny (“FindAFlip,” “we,” “us,” or “our”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. By registering you represent that the information you provide is accurate and that you are legally permitted to enter into this agreement.

You can create an account using an email address and password, or by signing in with Google. You are responsible for keeping your credentials secure and for all activity that occurs under your account. Notify us immediately at 0pierce.dev@gmail.com if you suspect unauthorized use.

We use industry-standard authentication (hashed passwords, short-lived access tokens, rotating refresh tokens) but no system is perfectly secure. You assume responsibility for the strength of your password and the security of devices you use to sign in.

FindAFlip aggregates publicly available marketplace listings (including eBay and Facebook Marketplace) and produces estimated resale profit calculations based on historical sold-item comparables. All profit estimates are informational only. They are derived from statistical models and incomplete data; actual resale value depends on market conditions, item condition, timing, and many other factors outside our control. We make no guarantee that any listing will sell, sell at a particular price, or yield a profit.

The Service is not investment advice or a recommendation to buy or sell any specific item. You are solely responsible for your purchasing and resale decisions and for complying with the rules of any marketplace you transact on.

The Service offers a free tier with limited functionality and a paid Premium tier billed on a recurring basis (Premium $20/month, Diamond $40/month). Premium subscriptions are processed by Stripe, Inc. Subscription terms, renewals, and refund policies are governed by these Terms and the Stripe terms applicable at checkout.

• Renewal. Premium subscriptions renew automatically each billing period unless cancelled before the renewal date. You can cancel at any time through the Customer Portal or by contacting us; cancellation takes effect at the end of the current billing period.
• Price changes. We may change subscription pricing with at least 30 days’ notice. Continued use after the effective date constitutes acceptance.
• Refunds. Except where required by law, subscription fees are non-refundable. We may, at our sole discretion, issue prorated refunds in cases of extended Service outage or billing error.
• Taxes. Prices exclude applicable taxes unless stated otherwise. You are responsible for any taxes assessed on your subscription.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law;
• Scrape, crawl, or systematically harvest the Service’s content or output (including profit estimates) other than through documented APIs we make available to you;
• Resell, sublicense, or commercially redistribute Service output without our written permission;
• Reverse-engineer, decompile, or attempt to extract source code, models, or weights;
• Use automated systems to create accounts, generate traffic, or bypass rate limits;
• Interfere with or disrupt the integrity or performance of the Service;
• Submit content that is fraudulent, defamatory, infringing, or otherwise unlawful;
• Use the Service to violate the terms of any third-party marketplace.

We may suspend or terminate accounts that violate these rules, without notice where warranted to protect the Service or other users.

The Service displays information from third-party marketplaces (such as eBay and Facebook Marketplace) and integrates with third-party services (such as Google for authentication and Stripe for payments). We are not affiliated with, endorsed by, or sponsored by any of these third parties. Their content, availability, pricing, and policies are outside our control, and we are not responsible for transactions you undertake with them.

Listing data shown in the Service may be incomplete, delayed, or inaccurate. Always verify details with the originating marketplace before making a purchasing decision. Images and listing content remain the property of their original sources and may expire or change without notice.

The Service, including its software, design, profit-estimation logic, branding, and non-listing content, is owned by Pierce Pokorny and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial flipping research.

Listing content sourced from third-party marketplaces remains the property of the respective marketplace operators and listing creators.

If you submit any content to us (including support messages, feedback, or bug reports), you grant us a worldwide, royalty-free, perpetual license to use that content to operate and improve the Service. You represent that you have the right to grant this license.

The Service is provided “as is” and “as available.”

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or that profit estimates will be accurate. Your use of the Service is at your sole risk.

To the maximum extent permitted by law, FindAFlip and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of the Service, even if advised of the possibility of such damages.

In no event shall our total liability for any claims related to the Service exceed the greater of (a) the total fees you paid us in the 12 months preceding the claim, or (b) USD $100.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

You agree to indemnify and hold harmless FindAFlip and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third party’s rights, or (d) your purchasing or reselling decisions made in connection with the Service.

You may delete your account at any time through your account settings or by contacting us. We may suspend or terminate your access if you violate these Terms, fail to pay subscription fees, or if we are required to do so by law.

On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) will survive.

We may modify or discontinue the Service at any time without liability. We may also update these Terms; when we do we will revise the “Effective date” above and, for material changes, give reasonable advance notice (such as by email or in-app banner). Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts located in Toronto, Ontario, and you consent to personal jurisdiction in those courts.
